If your old visa has not beenexpired at the time of re-entering . You will need to carry your new approved I-797. But your I-94 would have the expiration date as that of the expiration date as on your old Visa.

I had the same situation last year and the processing went smoothly at port of entry, but you may check for any chages in the regulations.

Guys,

I have another dumb question.

If you apply for COS from US for conversion from H4 to F1 and if the course study falls under TAL then will the COS procedure will take more than normal time? Have anyone experienced this before?

Yes, she should have her I-797 approval of extension and principal applicant Notice of action. If you are not traveling, make sure you make a copy of everything.

I did attend an IV meeting in NoVa a few weeks ago, I am keen on pushing an initiative of meeting periodically to discuss how we can collectively help our cause on this side of the river.

I have appeared for interviews in toronto. They have not looked at my pay stubs in detail. The most they would go is to check if you are still employed with the same firm. Again, this said each case is different. Stuff like Employer reputation, qualification etc., surely helps.

Hi,

I need to get my H1B stamped in Mexico. I know there are some agencies which offer a complete package trip to the Mexico US Consulate. Does anybody know some names and contact information?

I am based in Los Angeles and am pretty close to Mexico border. Do they have something in Southern California? Other places are also Ok.

I was working with company A and got approved I140(1 year back) after that I moved to company B using approved I140 and got 3 yrs H1B extension.After that during July,07 period I requested company A to apply EAD and i485(Company A mentioned as future employment).Now I am still with company B.
But now Company A asking me to come back.Since I have everything approved (i140) except i485(pending) do I need to go back to company A?

If I do not go to company A,can he cancel approved I140 ?

Need help/suggestion .

They say that, they can pay at 90/10 or 80/20
and also pay some amount in "per-diem"

This will make effective rate to be "more than 90%"

Is anyone currently working with this company ?

If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.


If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

In my opinion I think we should get the news guys into this and get the information out there about the irresponsibility with which they have mismanaged the whole process. Such kind of problems usually grab headlines when it happens with US citizens.

I think we need to be heard. Imagine, insurance companies violating makes news, social security makes news, airport security regulations and mismanagement makes news _ WHY CANT THIS? THIS IS SO CRUEL. HOW MANY HOURS, MONEY, EFFORT HAS GONE DOWN THE DRAIN? CAN WE NOT GET SOME NEWS CHANNEL TO COVER THIS? SOMEONE TO SPEAK TO A JOURNALIST ABOUT HOW AWFUL IT HAS BEEN????

THIS HAS ALL THE ELEMENTS OF PAIN, AGONY, AND DECEIT. Please comment. Only when we do this, will we get the EB numbers to get increased. Only then , the lawmakers will get up and smell the coffee. LEGAL IMMIGRANTS AND WHAT DO WE GET AFTER OBEYING THE LAW? MISMANAGEMENT THROWN AT OUR FACE.

Hi,

My sister is a citizen and she applied GC for my parents who are in India.She applied for I-130 in April and it was approved in 2 months.She now has to fill the form I-864 and is in the process of doing so.Meanwhile my parents would like to visit USA.They'll be coming in December and be staying for 6 mos.They have a 10 yr visa and visited us back in 2004.
My question is it ok for them to visit USA?I read that they might be denied entry becasue of their approved I-130.We do not want to apply AOS here and they will return in June 09.

Just realized that some thing is wrong with the USCIS web site. When I open my portfolio , I see an LUD on my EAD with 10/16/2007. (Today is 10/9/07)

My AP LUD date changed to 4/16/2007 (Not even applied in April 07).

Could this be DST bug ?

Did any one notice this ?

Hi,
My husband was had complete his MS from US and moved to H1 , recently went to India for and his H1 visa is rejected. I am on L1 so now he got his L2 visa approved.

I wish to know the following -
In order to start working as soon as possible what all options he has.
I long will L2 EAD will take?
Can he switch back to is orginal H1 once he come back to US? or he has to apply new H1.
Can he apply for both H1 and EAD. If so which one will be taken in to consideration if both are approved?

Please give you expert advice on what to do next.
