Guys,
Please help me...I do not have much knowledge about GC process. I am working on H1B visa from last 3 years with my current employer and they are ready to apply for GC but, I know that for GC in the same position I cannot use the experience gained during past 3 years. But if I apply for GC for the next level (as GC is for future employment) with the current experience and keep working in my current role until my GC is approved, do you guys see any problem with that? GC approval will easily take 4-5 years and during this time I can keep working in my current position and once GC is approved I can switch to the next level which is kind of promotion.
Thanks in advance for your suggestions.

If the H1-B came with I-94 attached to the I797 form, then your status would be H1-B from the day written on the I-94 form. From that day, you cannot work with the employer A without filing another H1-B with employer A.

For all of you, whose cases are in NBC (National Benefits Center), please update your status here.
I had to undergo finger printing twice last year and this could be a reason for it.
My case information
EB2
PD: Dec 2005
Case transferred to NBC: 06/09/2008
No interview notice yet
Went for FP twice last year
Should we start getting police clearance certificates as our priority dates are current?

Hello?
In Mid 2007, 7th year of H-1B transfer & extension was filed, and was no problem as I had an approved ETA-750 with ex-employer, but it was expired soon as the sponsors (ex-employer) company was closed at the end of 2007.
The 7th year approval period was 12/11/2007 ~ 12/10/2008 with the current employer.
I filed another labor certification (ETA-9089) on 10/23/2007 which was sponsored by my current employer, and it has not been approved yet.
Using this ETA-9089 pending more than 365 days, I filed an I-129 extension for 8th year of H1B last November 2008, but INS sent "Request For additional Evidence Sent" letter which was saying to be provided An evidence of pending / being processed for more than 365 days of labor certification or I-140 prior to 6 year expired of H-1B. we just realized that a memo was posted regarding this on 05/30/2008.
As I dont have this evidence... Please advise or recommend me...

Hi,
My husband was had complete his MS from US and moved to H1 , recently went to India for and his H1 visa is rejected. I am on L1 so now he got his L2 visa approved.
I wish to know the following -
In order to start working as soon as possible what all options he has.
I long will L2 EAD will take?
Can he switch back to is orginal H1 once he come back to US? or he has to apply new H1.
Can he apply for both H1 and EAD. If so which one will be taken in to consideration if both are approved?
Please give you expert advice on what to do next.

Hey HybridIllusion,
It all depends on what format your 2d image is in. If it is in AI or EPS, you can automatically import the image into Swift 3D and animate it. If it is a JPG or GIF, you might have a few more steps before importing into Swift 3D.
Take your image and import it into Flash. Export the Flash animation as AI (adobe illustrator) by going to File | Publish Settings | File Types tab. Check the AI box and then publish the movie. The image will be exported in the AI format. From the AI format, you can import into Swift 3D and animate with no limitations.

My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?
Given a situation, one way to dust a file is to send the medical with a cover letter.

Hi,
My PD is Dec-04 and I-485 filing date is Sept-07.
I changed my job in Aug-2008 and discontinued my H1B which is expired in Sept-2008. Now my only legal status is 'adjustment of status from H1B to Permanent Resident'. I think this is very common state most of the people waiting looong for GC fall into.
Now, I saw one of my friend's i-485 denied (with NO option to reopen!) bcoz an approved I-140 was not attached to this application. I agree that this is not simple mistake for USCIS can ignore, but there is always a 'very very remote' possibility that every application can be quetioned due to some flows in the filing.
Here is my question: Since I discontinued my H1B status and I am still in this country, can I apply for a fresh H1B? I am thinking because H1B quota is still open this year and to face any unexpected reason for 485 denial!
thanks in advance!

Two University of Maryland management professors have studied the question and say no:The use of H-1B and other work visas to hire foreign information technology (IT) professionals in the United States has attracted significant controversy and policy debates. On one hand, hiring high-skill foreign IT professionals on work visas can be advantageous for U.S. firms and the overall economy. On the other hand, high-skill immigration can adversely impact the wages of foreign and American IT professionals. This study uses data on skills and compensation of more than 50,000 IT professionals in the United States over the period 20002005 to study...

Republicans were working to break an impasse on a proposal that would let employers continue to handpick the high-skilled workers they want to get green cards, rather than requiring workers to qualify through a new, government-run point system.
That change, sought by Sen. Maria Cantwell (news, bio, voting record), D-Wash., and Sen. John Cornyn (news, bio, voting record), R-Texas, with vigorous backing from the high-tech community, could upset the delicate balance underlying the contentious immigration measure.

Here's my take on the new Visa Bulletin First, bad news for Dominicans. Separate cutoffs have now been established for the Family First and 2B preference categories which are now earlier than the worldwide dates. Family First is 01 JUN 2004 and 2B is 01 JAN 2002. Also, Indian numbers are pretty bad again with most categories stalled. Mexico is the only bright spot with some strong improvements in the employment categories. Family 1st- no improvement for most countries; three week advance for Mexico. Family 2A - world numbers jump from June 2010 to August 2010; Mexico stalled at March...

This incident opened my eyes and prodded me to move my fat ass to do something about this.
I just made my first contribution of $100 to IV.
Gandhi once said "Make your contribution, however insignificant you think it is. In reality, your contribution makes a huge difference".
Like he said, our little acts when combined become a formidable act and can accomplish a lot. I would suggest others make contributions too - especially now when everyone is excited - before you get back to the usual reticent state. let us not try to ride piggyback on some else's efforts.
-----------
Contributed $100 to begin with...More in future.
