The couple applied for the green card together. The husband applied under the EB1 category and his wife also applied with him as dependent. The green card of the couple has been approved and is expected to arrive in a month's time. The wife is not in US currently. She is outside US. Will the husband get his green card & the wife's green card in his wife's absence? Will there be any complications in the husband's green card in this case?

I work for company A. I am on a project actively with an end client from last one year. My company A stopped paying me from past 5 months in spite of them getting paid from the vendor. I have requested my company to release all my payments pending from last 5 months repeatedly. But they don't seem to bother. I am planning to change my employer now.
My question is Am i out of status since I am not getting paid from last 5 months? I have luckily all the copies of pay stubs till a month ago. Only thing is that I haven;t received them yet. Please let me know

Date for application:
my question: I had applied to Vermont service center and later it was transferred to Texas Service center... So Should i put Vermont or Texas as the applied USCIS office?
Also, The date of application is that the day i signed the application? or the received date that i see on the approved EAD?

Folks,
I just realized that I forgot to add a piece of my employment history to the DS-160. I only realized it once I set up the appointment for H1-B stamping through VFS. I have all the corroborating paperwork (W2, paystub etc.) for that period. Do I need to re-do the DS-160? I already have an appointment and if I cancel the appointment and re-do the DS160 I might run the risk of not getting the date of my choosing. The problem is my existing company is a "successor in interest" of the company I forgot to mention. That is, I got my I-797 from this previous company.
Please not that the facts in the existing DS 160 are true. It is just that I realized that there is a gap that I might have to fill.

you are right buddy. My husband was telling me the same thing today. If they can do what they did today, they are capable of pulling any tricks on us. I have also lost trust in this system. I am now more scared than ever for some reason.

I took the citizenship test, biometic now the second time .passed it 2 1/2 years ago . I was told the immigration did not have my filed . So Wait. Went to immirgation office 3 times. no result . Case under review ????? what is that mean????? Am confused ... No one can tell me what was going on . I have done no wrong. pay my taxes....

Hello,
I am in my 10th year of H1B visa. (GC in process). Every other time I went to INDIA , I got my stamping in INDIA except in 2009 when I returned on Advanced Parole because of a lack of time. Now I need to go to INDIA again in July and I observed this condition for visa stamping at INDIAN consulates which is :
Have the same class of U.S. visa which is still valid or that has expired less than 12 months from the scheduled date of interview.
Wish to apply for the same visa class (e.g. had an H1 work visa, now applying again for an H1 work visa)
My question is whether my last entry to US on Advanced Parole will be interpreted as not having the same class of VISA. After I entered on AP , I did renew my H1 Visa and it is valid upto April'2011.

With all the data from USCIS, FOIA and other tracker - random sampling its really hard to say. They all say different things. I think the only thing that is somewhat clear is that EB ROW is not going to use much of the visas this year and we expect some reduction in the backlog. There many estimates by people on this forum.

There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

My friend's company is India recently applied for his L1B visa. He is scheduled to go for stamping next week. But, another company has already premium-filed his H1B petition and is expected to hear back from the USCIS anytime now.
Here's the question: if he gets his L1B visa first, can he later on try and get his H1B visa and enter the country with the H1 visa? Second, if he goes for H1B stamping with an L1 visa already in his passport, will it affect the visa officer's decision in issuing a H1 visa?
Please chime in if anyone has done this before or has any insight on this matter.
