    I got green card through marriage. My wife is a US citizen and I came here legally and was in legal status(F-1) before getting married. We got married in August 2005. I applied for green card following year and finally got my card approved March 2008. I got a conditional residence which expires March 2010. I did all paperwork myself. My wife recomend me for an attorney for removal of condition. Attorney tells me that USCIS screwed up and sent me a conditonal residence card as under,"Immigration Marriage Fraud Amendments Act of 1986 (IMFA) on November 6, 1986. INA � 216, 8 USC � 1186a","Under IMFA, an �alien spouse� who obtained the status of an alien lawfully admitted for permanent residence by virtue of a marriage contracted less than 24 months before the date of admission is considered to have obtained such status on a conditional basis."
    Now he wants me to send the green card back to USCIS as at the time of approval of my petition my marriage had passed more than two years!
    I am confused. I need a second opinion.
    Please help

    Yes something basic seems to be missing in our immigrant community. I want to repeat these are just 6 users who are very vocal and influencing thousands of people.
    Sorry to say this, but it appears our worst enemies seem to be fellow immigrants, not anti-immigrants.
    All I can say is someone has to be criminally negative minded, to oppose a campaign where money is not even being solicited. This culture of hate has to go and has no place in the USA.

    This campaign along with the DREAM campaign was also supported by Murthy forum.
    Murthy is one of the top immigration lawyers. It is a moderated forum, and the lawyers are personally aware of the content. They have supported us on previous Advocacy days.

    As far as the question about law, I am no lawyer and will defer to admins. Core is in touch with many lawyers and I can assure you, they will pick up an action item, only if it has a very good chance of success.

    Also Greg Syskind, one of the best lawyers in the country is on our advisory board, and core talks to USCIS, law makers regularly. So to claim this is not legally possible is just absurd.
    On our home page we have the best minds on immigration listed, in our advisory board.

    So you have all the above lawyers, lobbyists, core who are supporting this and 6 people with EAD think its not possible?
    .

    I don't care them but they are influencing others to believe in them.

    I believe same. Those minds are not only selfish but they are really really cruel, cunning and they don't deserve to be part of american dream.. All they care is their green card..rest of eligible people who are waiting to file 485 can have unknown waiting time for their chance of filing 485 and can live in the state of limbo.

    Hope there are no issues legally for this to see as admin fix as you already mentioned that Murthy and Greg are aware of this initiative.

    When you use EAD it does not matter if the company got any money under the TARP program or not.

    You should not even bring this to the attention to your HR. Go and use EAD as if the company is just any other company, make sure that the job is "same / similar" and get a lawyer for using AC21 portability.

    GC is for future job, is your PERM was not suspended, you can continue with the same application.

    If you're on H1-B - YES - a transfer is required to work for company A becuase you resigned and left and technically company B owns your H1-B.

    There is no issue what-so-ever using AP to enter US. I don't know why you are mixing H1 with AP. Both are different. AP is just a travel Document that can be used to travel abroad and return to US. Does not matter if you have a H1 or not.

    Hey guys,

    If any one is a client of Cohen and Grisby and looking to appliy AOS now, have you heard anything from them asking for forms and docuements or when they will start submitting the applications.

    I looked at their website and they haven't posted a thing, nor have they sent an e-mail, like they sent after the first July bulletin came out in June.

    I was wondering if any one is in same situation as I am. By the way I already tried to reach them, but could not get through.

    If you call USCIS 1800 number, and you ask the representative to raise a service request then they email the service center asking for details. Most of the time, personnel from service center will call back with the information that you have requested. If you learn there is a way you can email the service center, please post here.

    Hi
    I transferred my H1 to new employer and need to go for visa stamping.
    I have a couple of qustions.

    1.I belong to south india and my regional consulate is chennai.Can I go for calcutta consulat as I heard chennai consulate has delays in vsa processing.In such case,can I have to show any emergency proof?

    2.My salary is 30k more than whatever is mentioned in petition.will it be a problem?

    3.I recently heard that consulate officer is asking for contact agreement between employer and client.But in my case I have some addition layer B in between my employer A and client.So how can I provide letter.Do I need to show 2 letters.From my employer A to layer B and layer B to client?

    House Democrats Try Softening Their Tone; Lawmakers Seek Republican Votes Amid Veto Threats (http://online.wsj.com/public/article/SB119491416890790655.html) By David Rogers | Wall Street Journal, Nov 13, 2007

    WASHINGTON -- Down in the polls, House Democrats are showing a little more finesse as they try to move their legislative agenda around the wall of veto threats thrown up by President Bush.

    Cute is out; conciliation is in. Late-night talks with Republican moderates intensified last week on the Democrats' signature health- care initiative -- extending coverage to millions of working class children. Staff negotiations continued during the holiday weekend, and Georgia Rep. Nathan Deal, a Democrat-turned-Republican with expertise on health and welfare issues, has been invited in by both sides as a broker.

    House Appropriations Committee Chairman David Obey (D., Wis.) last week abandoned a confrontational plan to pair defense and education budgets, which would have dared the president to veto both. Instead the two bills were sent separately to Mr. Bush, who could veto the education measure as early as today. Looking ahead to the override vote, Mr. Obey took care to preserve House Republican provisions regarding abortion, child vaccines and abstinence education.

    The House is scheduled Thursday to take up an antipredatory lending bill that is a showcase of cooperation between the chairman of the House Financial Services Committee, Rep. Barney Frank (D., Mass.) and his ranking Republican, Rep. Spencer Bachus of Alabama.

    "He called up and said why don't you come down to my office and tell me what you need to be on the bill," said Rep. Steve LaTourette (R., Ohio) of his own dealings with the chairman. Mr. Frank is a close ally of House Speaker Nancy Pelosi and has urged Democrats to permit more Republican amendments as a way to change the political tone in the House.

    "It's transactional -- you have to see what it brings," Mr. Frank said. "But Hubert Humphrey once said, 'Whenever I get cute, I blow it.' That's the same thing I'm saying: if you try to be too political there's a backlash."

    That backlash is evident: Congress's approval rating has fallen from 31% in March to 19% this month in the latest Wall Street Journal/NBC News poll.

    A year after returning to power, House Democrats are at a crossroads. The party's early agenda -- tougher ethics rules, a minimum-wage increase and more aid for college students -- is largely in place. To go further, the majority must overcome not just presidential vetoes but the often-crippling partisan bitterness left from 12 years under Republican rule.

    The war in Iraq, which permeates Washington and again divides the House this week, makes that cooperation harder. As the president lays down vetoes, he seems to prefer a divided Congress that poses less of a challenge. And the Senate's filibuster rules, which require a 60- vote supermajority just to get a bill to the White House, are an added frustration for House Democrats.

    Allies of Ms. Pelosi said she could do more to take the lead and soften the tone in the House by using her power over the Rules Committee to allow more Republican amendments.

    Last month's floor fight over the Foreign Intelligence Surveillance Act -- a controversial arena relating to the government's wiretapping activities -- is a case in point. The Rules panel disallowed all 27 Republican amendments. The minority retaliated with a procedural motion that successfully forced the bill to be withdrawn, and it still hasn't come back up for debate.

    Ms. Pelosi's combative nature doesn't make such a shift easy. When the president recently accused Democrats of being led from the left by the anti-war group Code Pink, she saw it as a slight on her and responded in kind, saying Mr. Bush was acting less like "the president of the United States" than a "a junkyard dog on television every day because he has nothing to produce."

    Going into 2008, the Californian said her party is well positioned on the issues most important to voters. Democrats think the child health-care fight is a long-term winner with bipartisan appeal. Party polls show her next priority, an energy bill that demands that cars be more fuel efficient, would appeal to independent voters. And tougher safety standards for imports from China is a third bipartisan issue that Democrats hope will improve Congress's image and is a reminder of Ms. Pelosi's early human-rights record on China.

    "Nothing is a setback, we're going forward," she said, sitting in her Capitol office.

    Ms. Pelosi's tough style borrows from her hero: the late Speaker Thomas "Tip" O'Neill of Massachusetts. Another Boston politician, and an O'Neill ally, Joseph Moakley, may be more relevant in Ms. Pelosi's predicament.

    Mr. Moakley, a former chairman and long-time fixture in the House Rules Committee, lived by the maxim that he was in power to "say yes, not no."

    "I always thought real power was the ability to say yes," Mr. Moakley said months before his death in 2001. "Because when I'd say yes, I found out they'd usually say yes back to me."

    In my company along with me 4 other folks also affected due to visa bulletin mess. I sent them an email on July 9th 2007 about flower campaign organized by IV to USCIS director. The sad part is no body showed any interest and did not bother to reply. They are also going to benefited by this decision. These people still beleive in Murthy and other lawyer firm updates. I really don't know how to make these folks interested in IV. Any ideas or other personal stories.
