Hi,
I am transferring my H1B from Employer A to B.
With Employer A, I had my recent H1B extension approved till Oct 31 2011.
I am going to have the period on this transfer as June 1 2009 - Oct 31 2011. (Which will 6 yrs in total on H1B status for me).
I have question on form I-129, "Requested Action" section.
Out of the following options, which one should I "Check":
1. Extend the stay of the person(s) since they now hold this status.
2. Amend the stay of the person(s) since they now hold this status.
Please let me know.

I am in a weird situation here, I was Laid off on July 21st with pay in lieu until 4th August. I had applied for Change of Status to F2 (my wife is on F1) on 17th August. On 31st August I got a job offer and applied for H1B transfer to USCIS on 8th September (using 15th august paystub as the latest).
At the same time i filed to USCIS to revoke my F2 application.
Today I got a notice from USCIS that my application for change of status to F2 is approved as of 09/21/2009.
Now, I dont know what to do, does it mean I am now on F2? Is my H1B transfer application still valid or I need to apply again this time on premium processing.
What should be my next course of action. Any help in this regard would be highly appreciated.

HI,
My wife is going to India and She has to get her H4 stamped again(I am on H1 and received my next 3 year extension and so did my wife).
My parents are also planing to visit me. Should I book my wife's appointment along with my parent's appointment , or should I book 2 different appointments one for my wife and one for both my parents.

I am not fully aware of all the benefits of having EAD after filing 485. If you have the knowledge about it could you please list down it in this thread.

as of now it lets the spouse to start working.. & then the not too fancy AC21 portability.. Advanced Parole for trvael outside the US etc..
in terms of GC its just another waiting phase..

Hello gurus,
My H1 expires in march 2009, I have valid EAD and AP, I want to renew my H1to be on the safer side.
My wife made use of her EAD for few months and now she is not working, and we are planning to visit India for few weeks next year and get H1 and H4 stamped.
here are my questions:
1. Can my wife get her H4 extension when I apply for my H1 extension ?
2. Does USCIS know that she used her EAD (Is there a way that they can find out) and will there be any problem in approving H4 extension ?
3. Now that she is not using her EAD, Is she back on H4 status ? She came here as H4 and never made a trip back.

You cannot be on H1-B if you are working using EAD.
2)
my fiancee is on H1 status and i want to change her status from H1 to H4 (H1 getting expired). will it be ok as long as i maiting H1 status?

In order to qualify for H-4, the person has to be a legal dependent on the person holding H1-B. AFAIK, fiancee is not legally a dependent.

Hi I just graduated last year as an accounting major. I recently got an offer for a Property Accountant position at a real estate company. So it's not a pulic accounting firm. I was wondering if I'm eligiable to apply for H1B without a CPA?
