Hi,
I am currently on H3 visa. My 2-yr term is coming to an end. My company had initially told me that they would find me a job internally and then relocate me to another location outside of the US after my training ends.
However, the company has not been able to find me anything in other regions, which essentially means I will be laid off. I want to know if the company is liable to pay me severance / air tickets back to my home country??
My employer is currently saying that they are not responsible for my airfare. That provision is only for H1B's. However, if the intent of H3 visa was to bring me for training and transfer me so that I could use that knowledge somewhere else. Even in the H-3 filing papers my company stated that their intent was to provide me employment in other regions after the end of the training. I don't understand how can they leave me stranded. They should be liable for something (severance, airfare)??
Please reply if you have any advice.

Every Tuesday, USCIS releases its data on the pace of usage of H-1B numbers. I'm monitoring that usage and projecting the end date for H-1B numbers. It's not complicated science, but I'm basically using a rolling average of the prior four weeks of H-1B usage to minimize the anomolies of one particular week and then assuming that usage over the prior month will continue at roughly the same pace. If usage picks up, the exhaustion date will be revised to be sooner and vice versa if usage declines. We actually saw a decline from prior weeks with 800 H-1B applications...

USCIS provides regular updates on the processing of FY2011 H-1B petitions. Today I got an SLUD on my pending 485 after almost more than a year. Last one was from July, 2008 (address change). Don't understand what exactly is going on. For RFEs are there usually SLUDs before? or just an hard LUD with message change? Anyone in same boat? :confused:

Opponents of Arizona's SB1070 immigration law scored another victory in the courts yesterday. In the case of Friendly House v. Whiting, the court overruled a motion to dismiss the case challenging the law. The judge noted that "Racial discrimination was a motivating factor for [S.B.] 1070�s enactment" which establishes a legitimate constitutional challenge to the law. Hi everybody,
I am in pretty awkward situation. i have got my H1b Stamped in august 2008. Did not go to US because of the bad market situation and opted for woking in India. Now my current indian comapny wants me to travel to US on business visa( i have got B1 stamped in 2004 for 10 years) for 1-2 weeks.
Now i want to know , if i have both the visa stamped( H1b & B1), can i travel to US on business visa without affetcing my H1B visa because i am planning to go US whenever i hear that market is improving.

Can I count part time experience obtained before my Bachelors degree for an EB2 petition?
I have 2.5 years of part time experience, can we use this and apply with MBA+1 requirements?

Fancy meeting you here, dohko! The experience at half time can be counted to be 1/2 time itself - i.e. 2 years under 20 hrs./week = 1 yr. full time.
Your experience however has to be obtained AFTER your Bachelor's degree.

Hi,
I am a July 2007 filer (EB3 India). In the coming weeks, my employer is opening up senior position in different states and has encouraged existing employees to apply.
If my employer is open to offering me a job for the new position, (and process a EB2 PERM/I-140 for the new position) what would be my option with the existing I-485.
Is it recommended to keep the existing I-485 as is an file a new one? Or should the existing one be updated with the new I-140 (EB2) when that gets approved? How does it affect AC21 portability if existing I-485 is updated.

My wife has her h4 visa stamping in a week's time. I have sent her all the documents required.
My question is, it is mandatory for her to carry my original I-797 petition and I-129?? I have sent photo copies of both the documents, but I read some where that she has to carry originals of these 2 docs. can you pls clarify??
