    USCIS has specifically answered a very similar question in 2004. The answer is "A change of status take effect automatically on the effective date noted in the [approval notice], even if there is an intervening admission...."

    Your H-1B status should therefore take effect automatically on 10/1/09, assuming it was approved as a change of status.

    Does anyone have the latest on labor substitution? I am being offered a pre-approved labor. I will have to switch to a not so good employer for the same. I want to know if there are known rumors at this moment about cancellation of pre-approved labor.
    Any advice would be highly appreciated.

    I guess this has become typical of every lawmaker to say 'We need to reform ______', without initiating any action. So far health care, immigration, financial industry have gone in that blank, more to come..
    Just like citizens criticize their governments, but when it comes to take action (cast their ballot atleast), they would choose not to.

    I have an approved I-140 and have a pending I-485 filed with NSC, received date 15 Aug 07. NSC I-485 processing date was moved up to Aug 15 a few days ago.

    Was wondering if anyone else with similar received dates got an approval or some form of reply from NSC?

    I am really unclear about the whole process of the i-90. My situation as whole is unclear to
    me. I gave a call to the USCIS to find out my status since i recieved my welcome letter by mail only to find out that my green card has been mailed back by usps and labeled "undeliverable". I dont know exactly what happen but i already started an i-90. If i wanted to travel outside the US, what would i need? I have seen people suggesting getting an i-551 stamp. But those people were renewing their green card. Would my situation be different as I actually never held a green card. Would they still stamp
    my passport so i can travel out of the country or would there be other ways to?
