I am looking for some advice regarding a seemingly peculiar situation.
my company has filed for my H1B this year alongwith h4 for my wife. My wife is on the verge of getting herself a job. My question is ...since this year's cap hasn't been reached....can she get a h1 visa and if yes how does her already having an application for h4 affect her h1b filing process.

I received a RFE on 485 for a updated G-325 form and a Employment letter stating the Job details, Salary and if the Immigrant visa petition(labor certification) terms still exist. Iam a Jul,2007 filer, I have another 12 days to respond, this RFE was received by the company attorney. Now neither Employer/Company Attorney are responding to Phone calls/Emails regarding responding this to RFE. I do not understand what is their concern but came to know that few others from the same company got RFE on 485. Time is running out and if there is no response to the RFE, eventually the case will be denied. What are my options, Iam in my 4th year of my H1. I have a Valid EAD till Nov'2010 and H1 valid till Aug'2011. What will be my status if the 485 gets denied. Can I transfer the H1 to another employer and will need to start the GC process all over again ?
Any advice suggestions appreciated.

I've written a number of times that we need to think about pursuing piecemeal immigration reform and give up on the notion of a comprehensive solution. Thank you. I checked it out. My nephew (7yrs) also plans to come for 3 weeks with my in laws. He has never been to the US before, and his parents are not coming either. The site mentioned that parents visa papers also have to be attached, I am not sure what this means. (His parents have never applied for the visa)

my husband's h1 ext is approved.
my h1 to h4 cos is still pending. If we go to canda for his h1 stamping and my h4 stamping with my h4 filing papers ( i-539) and receipt notice and come back to usa with successfull stampings, how will uscis know that i travelled to a consulate and got h4 stamping done.
Will they still continue to process my h4.
Do i have to inform uscis after I come back to usa of my successful stamping.
what should I expect on my pending case once i come back.

Hi All,

I have my I-140 approved with some kind of receipt number.
My lawyer filed my I-485 and it reached NSC on Aug 9, 2007.
I have not recd. any I-485 receipt notice or number yet.
Can i still track my I-485 progress using my I-140 receipt number on
the USCIS website somehow ?

Please help me. My EB2 priority date in 21Nov 2007. My I 140 is approved and yet to file for I 485. Now at work I have promotion offer from Sr developer to Team lead. Technologies I work for won't change, but I have to change my work location to different state in this case
do I have to file for PERM and I 140 again?
If I have to file 140 can I retain priority date?
Is there any other option for me to escape PERM refiling other than not accepting promotion :)?
Your advice is greatly appreciated.
